1. AGREEMENT TO TERMS These Terms of Use constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“you”) and 3sixt5 design PTY LTD, doing business as themed-decorations (“themed-decorations“, “we”, “us”, or “our”), concerning your access to and use of the https://www.themed-decorations.co.za website as well as any other media form, media channel, mobile website or mobile application related, linked, or otherwise connected thereto (collectively, the “Site”). You agree that by accessing the Site, you have read, understood, and agreed to be bound by all of these Terms of Use.

2. INTELLECTUAL PROPERTY RIGHTS Unless otherwise indicated, the Site is our proprietary property. This includes all source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics on the Site. The Content and the Marks are protected by copyright and trademark laws of South Africa and international conventions. You are granted a limited license to access the Site and download or print a copy of the Content solely for your personal, non-commercial use.

3. PRODUCTS, PRICING, AND AVAILABILITY We make every effort to display the colors, features, and details of our themed decorations and jumping castles as accurately as possible. However, your electronic display may not accurately reflect actual colors. All products are subject to availability.

Pricing: We reserve the right to change prices at any time.
Stock: While we strive for accuracy, if an item is out of stock after an order is placed, we will notify you to offer a substitute or a full refund.

4. PURCHASES AND PAYMENT We accept the following forms of payment:

Ozow / Secure Online Payment Gateways
Instant EFT / Credit & Debit Cards All payments shall be in South African Rand (ZAR). You agree to provide current, complete, and accurate purchase and account information.

5. JUMPING CASTLE HIRE (SPECIFIC TERMS) For customers hiring jumping castles in the Gauteng/Boksburg area:

Safety: Use of hired equipment is at the user’s own risk. You agree to follow all safety guidelines provided at the time of setup.
Liability: To the fullest extent permitted by the Consumer Protection Act, themed-decorations shall not be held liable for personal injury or property damage resulting from the use or misuse of hired equipment.
Weather: We reserve the right to cancel or postpone rentals in the event of extreme weather (heavy rain or high winds) for safety reasons.

6. SHIPPING AND DELIVERY We deliver nationwide across South Africa. Shipping fees are calculated at checkout. While we aim for fast delivery (Johannesburg, Cape Town, KZN, etc.), delivery dates are estimates and not guaranteed. Once a package is handed over to our third-party couriers, risk of loss or damage passes to the customer, subject to the courier’s terms.

7. RETURN/REFUNDS POLICY All returns are governed by our Return Policy and the South African Consumer Protection Act. Personalized or custom-themed items are generally non-returnable unless defective. Please inspect all goods upon delivery and notify us within 24 hours of any discrepancies.

8. PRIVACY AND POPIA COMPLIANCE Your privacy is important to us. In accordance with the Protection of Personal Information Act (POPIA), we only collect and process data necessary to fulfill your order. By using the Site, you consent to our collection and use of personal information as outlined in our Privacy Policy.

9. PROHIBITED ACTIVITIES You may not use the Site for any unauthorized purpose, including:

Systematic retrieval of data to create a database.
Circumventing security features.
Engaging in “spamming” or uploading viruses.
Using the Site to advertise competing services.

10. MODIFICATIONS AND INTERRUPTIONS We reserve the right to change or remove content from the Site at any time. We cannot guarantee the Site will be available at all times due to maintenance or technical issues. You agree that we have no liability for any loss or inconvenience caused by your inability to access the Site during downtime.

11. GOVERNING LAW These terms shall be governed by and defined following the laws of South Africa. 3sixt5 design PTY LTD and yourself irrevocably consent that the courts of South Africa shall have exclusive jurisdiction to resolve any dispute.
